1. Introduction

This agreement governs your use of the Pokeadeal mobile application and its associated services.

By accessing or using Pokeadeal's services, you agree to be bound by these terms, as well as the Privacy Policy and any other applicable policies or guidelines. If you do not accept these terms, you must immediately stop using the application.

Pokeadeal is a mobile application that allows users to share local deals and promotions directly with consumers, facilitating the discovery and sharing of exclusive nearby offers. It also connects users with local deals through an interactive map. The company 9527-8750 Québec Inc. owns and operates the Pokeadeal application and services.

2. Agreement Between the Parties

By using the Pokeadeal platform, you, as a user, agree to be bound by these terms. Pokeadeal acts as an intermediary to facilitate the sharing of local deals and promotions. If you do not accept these terms, you must immediately stop using the services.

3. Services Provided by Pokeadeal

Pokeadeal provides a platform that allows users to create and share local deals and promotions through the mobile application.

• Display of promotional content
• Facilitation of the purchase of products or services from merchants
• Collection and analysis of data related to consumer interaction with listings
• Use of geolocation to offer location-based deals
• Access to the device camera for QR code scanning and product image capture

Pokeadeal provides access to an interactive map displaying promotional offers ("deals"), the ability to view deal details, notifications for nearby offers via geolocation, and in-app deal validation.

4. User Eligibility

Use of Pokeadeal is reserved for individuals aged 18 and over. By using the services, you represent that you are of legal age to enter into a binding contract.

5. User Responsibilities

Users are responsible for providing accurate information. They also agree to provide accurate information when creating an account and must use deals and offers honestly and lawfully, avoiding any fraudulent or malicious activity. All users must refrain from using bots, scripts, or other automated tools to interact with the platform.

6. Content Rules

Users may only share content that is legal, respectful, and appropriate. Prohibited content includes, but is not limited to:

• Pornographic or sexually explicit content
• Promotion of weapons, drugs, or illegal substances
• Hate speech, violence, threats, discrimination, or incitement to hatred
• Invasion of privacy or personal information without consent
• Viruses, malware, or other malicious code

Pokeadeal may remove any content deemed inappropriate, illegal, or contrary to these terms and may suspend or terminate a user's access. Users must interact with content responsibly, avoid fraudulent activities, and respect the rights of others.

7. User-Shared Deals

Users may share deals and promotions, but Pokeadeal does not guarantee their accuracy, quality, or availability. Pokeadeal is not responsible for disputes or dissatisfaction related to user-shared deals; users are responsible for ensuring their content complies with applicable laws and regulations. Users must not share fake deals or false promotions with the intent to mislead.

8. Prohibited Activities

Users must not:

• Violate any laws or regulations
• Promote illegal, harmful, or offensive content
• Attempt to manipulate or deceive the platform's algorithms or other users
• Engage in fraudulent or harmful activities
• Use bots or automated means to access the platform
• Share content promoting illegal activities
• Share offensive or discriminatory content
• Share content without the consent of others
• Manipulate systems or algorithms
• Share inappropriate content

9. Intellectual Property

Pokeadeal holds the intellectual property rights to the platform, including the application, website, and associated content and technologies. Users retain rights to the content they submit but grant Pokeadeal a license to use, display, and distribute that content as part of the services. This license is non-exclusive, worldwide, and royalty-free. Users may not reproduce, distribute, or modify platform content without authorization.

10. Privacy and Data Security

Pokeadeal respects user privacy and collects, stores, and uses personal data in accordance with the Privacy Policy. This policy details the collection, use, and protection of location and camera data. Pokeadeal takes reasonable measures to protect user information.

11. Limitation of Liability

Pokeadeal is not liable for indirect, incidental, special, or consequential damages resulting from the use of or inability to use the services, including loss of profits, business interruption, or data loss. Pokeadeal does not guarantee the availability, accuracy, or reliability of the platform's services.

Pokeadeal is not responsible for errors or omissions in user-published deals, for losses or damages resulting from use of the service, or for interruptions or failures of the application.

12. Modification or Termination of Service

Pokeadeal may modify, suspend, or discontinue any part of the services at any time, with or without notice. Pokeadeal may suspend or terminate accounts that violate these terms.

13. Governing Law and Dispute Resolution

These terms are governed by the laws of the province of Quebec. Any dispute relating to these terms will be resolved by binding arbitration in Montreal, Quebec, under the rules of the Canadian Institute for Arbitration and Mediation (CIAM).

14. Updates to the Terms

Pokeadeal may modify or update these terms at any time. Changes take effect upon publication on this page; users are encouraged to review the terms regularly.
